What does Odessa city code say about the right-of-way?
Odessa city code covers right-of-way construction in Chapter 3, Article 3-15, Division 3. Three sections there bear on a street or alley drop: §3-15-183 on street use permits, §3-15-190 on barricades and lights, and §3-15-177 on dust and debris. None of the three names dumpsters or roll-off containers.
| Section | What it says, in short |
|---|---|
| §3-15-183, street use permit | Covers use of the right-of-way more than 10 ft from the back of the curb for minor improvements. The use must not create a safety hazard. |
| §3-15-190, barricades and lights | Work in or next to any street, alley, sidewalk or public place needs barricades, plus lights from sunset to sunrise, at the permittee's cost. |
| §3-15-177, debris control | Dust and debris must be controlled. |
We found no container permit, fee or lead time in the code. That does not prove the city has no rule for a dumpster in the street. Check with the City of Odessa before you place a container in a street or alley.
The law is what the code says. Our advice is separate: use the driveway when you can. Confirm with your city, HOA or landfill.

Can the dumpster go in the alley behind your house?
An Odessa alley is public right-of-way, the same as the street, so check with the City of Odessa before a roll-off goes there. City code §3-15-190 names alleys along with streets and sidewalks when it calls for barricades and lights. City trash service also uses Odessa alleys, and a roll-off can block the truck.
Alleys are often narrow, with power and cable lines overhead. The roll-off truck typically needs about 60 ft of straight approach and about 23 ft of clear space above.
Does your HOA have its own dumpster rules?
An HOA can set rules for a driveway dumpster even where the city sets none. Common HOA limits cover how many days the dumpster can stay, where it sits and whether it must be screened. Read your HOA documents or call the manager before booking, so the 7-day rental doesn't break a rule.
What if you live in West Odessa or out in the county?
West Odessa and the other unincorporated parts of Ector County sit outside Odessa city limits, so county rules apply, not city code. We could not find a published Ector County rule for roll-off dumpsters on county roads. Call Ector County before placing a dumpster near a county road.
A spot on your own lot avoids the question. Read dumpster rental in West Odessa for rural placement tips, or the Ector County page for the small towns.
Is Midland the same as Odessa?
Midland is a separate city with its own code, so Odessa's sections don't carry over. Midland requires haulers working there to hold a city Garbage Hauler's Permit for each vehicle. We found no published Midland rule for a renter's dumpster in the street. Call the City of Midland before using a street spot there.
The Midland dumpster rental page covers that city's landfill and drop-off rules.

How do you keep the dumpster off the street?
The simplest way to skip the street question in Odessa is the driveway. A 20-yard dumpster needs a 22 by 8 ft spot, and a 10-yard needs 12 by 8 ft. The truck typically needs about 60 ft of straight approach. Our drivers set wooden boards under the rails on concrete and asphalt.
If the driver can't place the dumpster, a $125 trip fee applies. The driveway placement guide covers clearance, and the dumpster size guide helps you pick a bin that fits the space.

Dumpster permit questions in Odessa, TX
Can the City of Odessa fine me for a dumpster in my own driveway?
We found no Odessa code section that names roll-off dumpsters, and a driveway keeps the bin off the public right-of-way. We can't speak for the city or give legal advice. If you live in an HOA neighborhood, its rules can still limit days or placement. Call the city with any doubt before delivery day.
Do I need cones or lights if the dumpster sits near the street?
Odessa code §3-15-190 calls for barricades, plus lights from sunset to sunrise, for work in or next to a street, alley, sidewalk or public place, at the permittee's cost. Whether the city applies that to a parked roll-off is the city's call. Ask the City of Odessa when you check on a street spot.
Who checks with the city about a street spot, me or the hauler?
Tell us when you book that you want the street or alley, and we will share what we know about the Odessa rules. Final approval comes from the City of Odessa, not from us. Until the city says the spot is fine, plan on your driveway or a private lot. Our rental terms cover placement.
How many days can a dumpster stay in an Odessa driveway?
We found no Odessa code section that limits how long a roll-off can sit in a private driveway. Your HOA may set its own limit. Our rental includes 7 days, and each extra day is $25, so you can keep the dumpster until the job is done. Call for pickup as soon as the load is finished.
